Judge of the Probate of Wills as for the County of Berkshire— The Subscriber states to your Honor, that Simon Stone late of Windsor in said County, deceased, intestate, died at said Windsor, on the twenty fourth day of December last, leaving Charlotte Stone his widow, residing at said Windsor, and Ira Stone residing at said Windsor, of age, Oren Stone residing at Hinsdale in said County, of age, Ward Stone of about fifteen years of age, Melinda Stone near fourteen years of age, Philander Stone about thirteen years of age, and Almira Stone about nine years of age, all residing at said Windsor, his only heirs at law. William Walker -----back:----- Simon Stone Statement of Facts Jany. 5. 1819 Recorded Book 22, P. 370 --------------------------[Appointment of administrator, and bond:]------------------------------- KNOW ALL MEN BY THESE PRESENTS, THAT WE Asa Hall Jr. as principal, Asa Hall and Gideon Parsons as Sureties, all of Windsor in the County of Berkshire within the Commonwealth of Massachusetts, are holden and stand firmly bound and obliged unto WILLIAM WALKER, ESQUIRE, Judge of Probate of Wills, and for granting Administration within the County of Berkshire, in the full and just sum of Ten Thousand dollars, to be paid to the said WILLIAM WALKER, Esquire, and his successors in said office: To the true payment whereof we do bind ourselves, and each of us, our, and each of our heirs, executors and administrators, jointly and severally, by these presents, sealed with our seals, DATED the fifth day of January in the year of our Lord one thousand eight hundred and nineteen— THE condition of this Obligation is such, that if the above bounden Asa Hall Jr., Administrator of all and singular the goods and estate of Simon Stone late of Windsor in said County, deceased, do make, or cause to be made, a true and perfect inventory of all and singular the real estate, goods and chattels, rights and credits of said deceased, which have, or shall come to the hands, possession or knowledge of him the said Administrator or into the hands or possession of any other person or persons, for him, and the same, so made, do exhibit, or cause to be exhibited into the Registry of the Court of Probate of the said County of Berkshire, at or before the fifth day of April next ensuing; and the same goods and chattels, rights and credits, and all other the goods and chattels, rights and credits of the said deceased, at the time of his death, which, at any time after, shall come to the hands and possession of the said Administrator, or into the hands and possession of any other person or persons, for the said Administrator, do well and truly administer according to law: and further do make, or cause to be made, a just and true account of his said Administration, upon oath, on or before the fifth day of January, which will be in the year of our Lord one thousand eight hundred and twenty— and all the rest, residue, and remainder of the said goods and chattels, rights and credits, which shall be found remaining upon the said Administration account, (the same being first examined and allowed by the Judge, for the time being, of Probate of Wills, and for granting Administrations within the County of Berkshire, aforesaid) shall deliver and pay unto such person or persons, respectively, as the said Judge, by his decree or sentence, pursuant to law, shall limit and appoint: And if it shall hereafter appear, that any last will and testament was made by said deceased, and the Executor or Executors therein named, do exhibit the same into the Court of Probate of the said County of Berkshire, making request to have it allowed and approved accordingly; if the said Administrator above bounden, being thereunto required, do render and deliver the said Letter of Administration (approbation of such testament being first had and made) into the said Court; then the before written Obligation shall be void, and of none effect, or else shall abide and remain in full force and virtue. At a Court of Probate begun and holden at Lenox within and for said County on the fifth day of January A.D. 1819 The within Bond is examined, approved and ordered to be put on file. William Walker -------------------------------[Representation of insolvency of estate:]---------------------------- To the Honourable WILLIAM WALKER, ESQUIRE, Judge of Probate of Wills, &c. for the County of Berkshire. HUMBLY SHEWS Asa Hall Junr. Administrator on the estate of Simon Stone late of Windsor in the County of Berkshire deceased, THAT such are the Conditions and Circumstances of the said deceased’s Estate, (the particulars of which he is ready to lay before your Honor) that he is apprehensive it will be insufficient to pay all the just Debts which the said deceased owed; he therefore represent [sic] the said Estate as Insolvent, and pray that your Honor would nominate and appoint Commissioners to receive and examine the Claims of the several Creditors thereof, according to law. At a Court of Probate, holden at Lenox within and for the County of Berkshire, on the fifth day of January A. D. 1819. ORDERED, by the Court, that Asa Hall Jun., Administrator of the estate of Simon Stone late of Windsor in said County deceased, intestate, publish notifications of his appointment to, and acceptance of the trust aforesaid, by giving bond as the law directs; by posting up the same in some public places in Windsor aforesaid, the last residence of the deceased: and also by publishing the same in the Pittsfield Sun Printed at Pittsfield three weeks successively, all within three months from his appointment, Given under my hand, the day and year aforesaid. NOTICE is hereby given, that the subscriber has been duly appointed appointed [sic] Administrator of the estate of Simon Stone late of Windsor in the County of Berkshire deceased, and has taken upon himself that trust, by giving bond as the law directs. All persons having demands upon the estate of the said Simon [Stone] are requested to exhibit the same; and all persons indebted to said estate, are called upon to make payment to Asa Hall Junr. To Thomas Allen Esquire, of Hinsdale and Gideon Parsons, Yeoman of Windsor in said County—GREETING. WHEREAS Asa Hall Jr. Administrator on the estate of Simon Stone late of Windsor in the County of Berkshire, deceased, has represented to me WILLIAM WALKER, ESQUIRE, Judge of Probate of Wills, &c. for said County, that the said Estate is insolvent, and insufficient to pay all the just debts which the said deceased owned: I DO, therefore, hereby nominate and appoint you to be Commissioners, with full power to receive and examine all the Claims of the several Creditors to the said Estate, excepting those of the Administrator and Commissioners you having first caused the times and places of your meeting, to attend them for that purpose, to be made known, by causing an Advertisement thereof to be inserted [in] the “Pittsfield Sun” printed in Pittsfield three weeks successively, ten days at least, before your first meeting. And six months are hereby allowed unto the said Creditors for bringing in and proving their claims; at the end of which time you are to make report, and present unto me, upon Oath, a list of all the claims that shall have been laid before you, with the sums you shall allow on each Claim, and upon what evidence they are claimed; distinguishing such claims as are for Taxes and Debts due to the Commonwealth, and expences of the last sickness of the said deceased, and such claims as shall not have been satisfactorily made out. [signed] William Walker -----back:----- Simon Stone Petition & Decree for assignment of Dower September 6, 1820 Recorded Book 23, P. 500 ---------------------------------[Assignment of dower:]------------------------------------- BERKSHIRE ss. At a Court of Probate, holden at Lenox within and for the County of Berkshire, on the fourth day of April A. D. 1821, before the Hon. WILLIAM WALKER, Esq. Judge of said Court. THE annexed Instrument being presented to me, the said Judge, as an assignment of Dower in the Real Estate of Simeon Stone [sic] late of Windsor in said County, deceased, made, under Oath, by the aforenamed Thomas Allen Esq. and others, to that service duly appointed: I DO THEREFORE DECREE, that the same be, and it is hereby accepted, ratified and confirmed, as such; and I order the same to be recorded. In testimony whereof, I hereunto set my hand, and seal of said Court. BERKSHIRE ss. To Thomas Allen Esq. of Hinsdale in said County, Daniel Dana Esq. and Ephraim Baldwin both of Windsor in said County—good and sufficient Freeholders, GREETING. PURSUANT to the authority vested in me by the laws of the Commonwealth aforesaid, I hereby appoint and authorize you to appraise all the Real Estate whereof Simon Stone late of Windsor in said County, deceased, testate, died seized and possessed, in his own right, within said Commonwealth, each piece and parcel by itself, and to make an inventory thereof, expressed in words at length. When you have perfected your inventory, you are to assign and set off to Charlott Stone the widow of said Simon, one just third part thereof, in productive value, for her dower in the estate of said deceased, to hold the same during her natural life— AND if any part of the said Real Estate shall be found to lie in common and undivided, with any other person or persons, you are authorized to sever and divide the same, first giving all persons interested due and seasonable notice. EACH part or portion you are to distinguish by plain and lasting metes and bounds; and, if necessary, you will employ a Surveyor to assist you. Before you proceed, you are to give notice to all persons concerned; and are to be under oath to perform this service faithfully and impartially. If all persons interested be satisfied with your proceedings, let them countersign your return. OF this warrant you are to make due return, as soon as may be, with your doings annexed thereto, unto the Probate Office of said County. GIVEN under my hand and seal of office, at Lenox this Sixth day of September Ammo Domini eighteen hundred and twenty— [signed] William Walker Judge of Probate. -----back:----- Simon Stone Warrant to set off Widow’s dower— Berkshire ss. October 2. 1820. Then said Baldwin and Dana came before me and severally made oath that they would faithfully and impartially perform the service assigned them in the written Warrant. Thomas Allen, Just. Peace Berkshire ss. Oct. 7th 1820. Then the within named Allen came before me and made oath that he would faithfully and impartially perform the service assigned him in the within Warrant. Thomas Thompson Just. of the Peace ----------------------------[attached Inventory of the real estate:]---------------------------- Berkshire ss. October 7th 1820. We the subscribers, Commissioners named in the Warrant hereto annexed, having first severally taken the oath therein required and given due notice to all parties interested, have performed the service assigned in and by said Warrant as follows, viz— We have made the following Inventory of the real Estate whereof said Simon Stone died seized in his own right within the Commonwealth. No. 1. Fifty acres of wood land in Peru in said county, purchased by the deceased of Amos Kingsley, two hundred and ninety two dollars. $292.00 No. 2. Said deceased’s homestead in Windsor, being seventy five Acres of land with the buildings thereon, twelve hundred and forty three dollars and fifty cents. $1243.50 Total of Inventory fifteen hundred and thirty five dollars and fifty cents. $1535.50 We have sett off and assigned to said Charlott Stone, widow of said Simon as and for her dower in the estates aforesaid, the following pieces and parcels each piece and parcel being a part of the homestead aforesaid. First. One tract of land bounded thus, to wit beginning on the southerly line of the county Road, at the northwesterly corner of Asa Hall Junior’s land; then running west, eight degrees south, on said Road, twenty seven rods and eight links; then west, eleven degrees north on said road, twenty rods and sixteen links, to a stake and stones in the corner of the garden next to the dwelling house; then south [text missing from photocopy] minutes west, twenty seven rods to a stake and stones; then east, thirty degrees south, forth four rods to a stake and stones; then south, fourteen degrees and thirty minutes west, twenty eight rods and eight links, to a stake and stones; then east, twenty two degrees south, fifty four rods, to an hemlock tree & stones; then north, thirteen degrees west, ninety nine rods, on line of said Hall, to the place of beginning, containing twenty seven acres and eighty seven rods of land, which we appraise at three hundred and twenty five dollars. $325.00 Second. A tract bounded thus, viz, beginning on the northerly line of the easterly or newest barn on said homestead at the northeastwardly corner of the threshing flower [floor]; then running south, twenty one degrees west, on the easterly line of said floor, three rods and four links to a stake and stones; then east, twenty one degrees south, one rod and thirteen links to a stake and stones; then north, twenty one degrees east, three rods and four links, to a stake and stones; then west, twenty one degrees north, one rod and thirteen links to the place of beginning. With this tract we have sett and assigned to said Charlott the right to use the said floor, in common with the heirs and assigns of said Simon, so far as may be necessary to get in her Grain and forage and do her threshing and get her property from her part of said barn from time to time as her occasions may require; and also the right of at all times passing and repassing to and from said barn over the contiguous lands of said heirs. The last described tract, with the portion of the barn standing thereon and the appurtenances and privileges aforesaid we appraise at twenty five dollars. $25.00 Third. A tract of land described thus, to wit, beginning at the northeasterly corner of Wm. Parsons’ land, on the northerly line of the county road; then running north, thirteen degrees west, three rods, to a corner found by the junction of two stone walls; then west, sixteen degrees north, forty two rods and seven links, to a small maple tree marked; then south, fifteen degrees west, sixteen rods and three links to a stake and stones on the northerly line of said road; then easterly, on last mentioned line, thirty three rods to the place of beginning, containing two Acres and one hundred and thirty seven rods of land, which we appraised at twenty five dollars and eighty five cents. $25.85 Fourth. We have sett off and assigned to said Charlott the northeast square room in the dwelling house on said homestead, the east bed room and buttery in said house, with all the land on said three rooms, the chamber over said square room, an undivided third part of the cellar under said house, the right of at all times using the oven in said house so far as may be necessary for doing her baking; and the right in common with said heirs of using the cellar and chamber stairs and the front entry and of passing and repassing through the kitchen so far as may be necessary to the occupation and enjoyment of the property assigned her as aforesaid. We have also assigned to her part of the wood house adjoining said dwelling, to wit, eight feet from the south end thereof, beginning at said south end and extending northerly, carrying the full width of said wood house eight feet, together with all the land under that part of said wood house sett to her as abovesaid, with the right of passing and repassing through the kitchen to and from the house. The premises with the the [sic] appurtenances and privileges fourthly and lastly above described we have appraised at one hundred and thirty three dollars and thirty three and a third cents. $133.33-1/3 Fifth. We have also sett and assigned to her one undivided fourth part of the pew in the congregational meeting house in said Windsor of which said Simon at his decease owned the one half, and have appraised said fourth part at two dollars and sixty five cents. $2.65 Each piece and parcel of land so sett off and assigned to said Charlott we have distinguished by plain and lasting meets and bounds—all which is submitted. Simon [sic] Oren Stone Ira Stone William Prince Guardian to all said Simon’s Minor Children --------------------------------[Settlement of personal estate:]----------------------------------- Commonwealth of Massachusetts Berkshire ss. At a court of Probate holden at Lenox within and for said County on the fourth day of April A. D. 1821 before the Hon. William Walker Judge of said Court A settlement of the personal Estate of Simeon [sic] Stone late of Windsor in said County deceased, intestate as ordered by the said Judge The Probate amount of the personal Estate of said intestato including his rights and credits as appears by the account of Asa Hall Junr Administrator thereof is one thousand five hundred eighty four dollars and eighty eight cents -- $1584.88 The whole amount of the account of the said Administrator against said Estate for the Expenses of settling the [sum?] payment of debts and funeral charges as appears by said account is seven hundred sixty one dollars and Eighty three cents -- $761.83 Which last mentioned sum being deducted leaves in the hands of the said Administrator a balance of Eight hundred twenty three dollars & five cents -- $823.05 It is thereupon ordered and deemed by the said Judge that the said balance be divided and paid to and among the widow and heirs at Law of said deceased viz to Charlotte the widow, the sum of two hundred seventy four dollars and thirty-five cents and to Oren Stone Ira Stone Melinda Stone, Ward Stone, Philander Stone and Almira Stone children & heirs of said deceased viz to Each of them the sum of ninety one dollars and forty five cents, to be paid by said Administrator in articles borne on the inventory at Inventory prices so far as they remain and will Extend. BERKSHIRE ss. To Thomas Allen Esq. of Hinsdale Ephraim Baldwin and Gideon Parsons of Windsor, in said County, and disinterested Freeholders, GREETING. YOU are hereby appointed and impowered to make an Inventory of all the Estate whereof Simon Stone late of Windsor in the County of Berkshire deceased, died seized and possessed in said County of Berkshire, and (according to your best skill and judgment) truly and justly to appraise the same, under oath, according to the present value thereof, in lawful money of this Commonwealth. And you are to make return of this Warrant, with your doings therein, into the Probate Office of the said County, within three months from the date hereof. Then said Thomas Allen came came [sic] before me and made oath that he would faithfully and impartially perform the service to which he is appointed by the within Warrant. By virtue of this Warrant, having first severally taken the oath therein required, we have made an Inventory of the Estate of said Simon, within mentioned, as herein required, and said Inventory is hereto annexed. At a Court of Probate, begun and holden at Lenox within and for the County of Berkshire, on the second day of February A. D. 1819, before the Hon. WILLIAM WALER, Esq. Judge of said Court. PERSONALLY appeared Asa Hall Junr. Adm.r of Simon Stone late of Windsor in said County, deceased, and made solemn Oath, that the annexed is a full and perfect Inventory of all the Estate whereof the said Simon died seized and possessed, in the County of Berkshire, so far as has come to his knowledge, and that if any thing further should hereafter appear, he will render a further Inventory or Inventories thereof. WHEREUPON the said Inventory is received, examined, allowed, and ordered to be recorded.
